These Terms and Conditions of Use (hereinafter "Terms") govern the use of the Dicte service (hereinafter "the Service"), an AI-powered meeting audio recording, transcription and analysis solution provided by Livdeo SAS, a company registered in France under number 805 407 012, with its registered office at 2 grande rue, 70190 Bussières, France (hereinafter "Livdeo" or "we").
By using the Service, you agree to be bound by these Terms. If you do not accept these Terms, you must not use the Service.
Dicte is a Software as a Service (SaaS) that offers artificial intelligence-based audio recording, automatic transcription, analysis, and summarization of meetings.
To use the Service, you must be an individual at least 18 years of age or a duly represented legal entity. You must have the legal capacity to enter into a binding contract.
Using the Service requires creating a user account. You agree to provide accurate, complete, and up-to-date information when creating your account and to keep it updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
You agree to use the Service in compliance with these Terms, applicable laws, and best practices. It is specifically prohibited to:
The Service is offered in different subscription plans: "Free", "Plus", "Business", and "Enterprise". The specific features and limitations of each plan are described on our website.
For paid plans, you agree to pay the subscription fees according to the terms defined at the subscription time. Payments are due in advance and non-refundable, except as required by law.
Livdeo reserves the right to modify its prices at any time. Any price change will be notified at least 30 days before it takes effect.
The Service, including all software, designs, texts, images, and other content, is the exclusive property of Livdeo and is protected by intellectual property laws. No intellectual property rights are transferred to the user.
Livdeo grants you a limited, non-exclusive, non-transferable, and revocable license to use the Service in accordance with these Terms and the features of your subscription plan.
You retain all intellectual property rights to the content you submit to the Service (hereinafter "User Content"), including but not limited to audio recordings, transcriptions, and analyses generated from your data.
You grant Livdeo a worldwide, non-exclusive, royalty-free, revocable, and limited license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content solely for the purpose of providing you with the Service and operating it in accordance with its intended functionalities. This license is strictly limited to the duration necessary for the provision of the Service and automatically terminates upon deletion of your content or closure of your account.
Livdeo commits not to use, share, or disclose your User Content for purposes other than providing the Service, except in the following cases:
You are fully responsible for any User Content you submit to the Service. You warrant that you have all necessary rights to grant the license mentioned in Section 5.3.2 and that your User Content does not violate third-party rights, applicable laws, or these Terms.
You may delete your User Content from the Service at any time, which will terminate the license granted to Livdeo, subject to Livdeo's right to retain backup copies for a reasonable period for legal and regulatory compliance purposes.
Unlike many AI-based services, Livdeo commits not to use your User Content to train, improve, or develop its AI models or services, unless you give your explicit and specific consent for this purpose.
The use of your personal data is governed by our Privacy Policy, which is an integral part of these Terms.
By using the Service, you consent to the processing of your data in accordance with our Privacy Policy and the following provisions:
You are responsible for obtaining consent from all meeting participants for the recording and processing of their voices and statements by the Service.
Livdeo commits to comply with the General Data Protection Regulation (GDPR) and all applicable data protection laws.
Livdeo strives to provide a quality Service but cannot guarantee that the Service will be uninterrupted, fast, or error-free.
While Dicte strives to provide accurate transcriptions and analyses, you acknowledge that the Service uses artificial intelligence technologies that may contain errors or inaccuracies.
To the fullest extent permitted by applicable law, Livdeo shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the Service.
You may terminate your subscription at any time by following the procedures provided for this purpose in your user account.
Livdeo reserves the right to suspend or terminate your access to the Service in case of violation of these Terms or for any other legitimate reason, with or without notice.
Upon termination, your access to the Service will be immediately interrupted. Livdeo commits to delete or anonymize your personal data in accordance with its Privacy Policy and applicable laws.
Livdeo reserves the right to modify these Terms at any time. Users will be informed of significant changes at least 30 days before they take effect. Continued use of the Service after the effective date of the modifications constitutes acceptance of the new Terms.
These Terms are governed by French law. However, this choice of law does not affect your rights as a consumer under the mandatory consumer protection laws of your country of residence.
Any dispute relating to the interpretation or execution of these Terms will be subject to the exclusive jurisdiction of the French courts, subject to any mandatory legal provisions to the contrary. If you are a consumer, you may have the right to bring legal proceedings in the courts of your country of residence.
If any provision of these Terms is deemed invalid or unenforceable, the other provisions shall remain in force.
You may not assign or transfer your rights or obligations under these Terms without Livdeo's prior written consent.
